Terms and conditions
These terms apply to orders placed through this shop.
Scope
These terms apply to orders from consumers and businesses placed through the shop at sweetsolana.com. Differing terms are rejected unless they are expressly agreed to.
The contracting party is Fabian Wimberger, Am Sonnenhang 11, 4240 Freistadt, Austria.
How the contract is formed
Showing a piece in the shop is not a binding offer. Completing the payment through Stripe is a binding offer; the contract is formed when the confirmation email is sent.
For sold-out pieces no contract is formed and any payment already made is refunded in full.
Prices and payment
All prices are final prices in euro including duties, plus the shipping cost of the chosen zone. No VAT is shown under the Austrian small-business scheme.
Payment runs through Stripe by card, Apple Pay, Google Pay or SEPA direct debit. Payment data is not stored by this shop.
Delivery
Finished pieces ship within 2 to 4 working days, commissions on the date given in the quote. The times are estimates, not guaranteed dates.
For consumers the risk passes when the goods are received.
Retention of title
The goods remain the property of the seller until payment is complete.
Withdrawal and returns
Consumers have 14 days to withdraw; details, exceptions and the return address are under Right of withdrawal.
Warranty
Statutory warranty law applies. For a defect, a message with a photo to contact@fabianwimberger.at is enough; the piece is repaired, replaced or refunded depending on the case.
Printed pieces are one-offs: colour differences between batches, visible layer lines and dimensional deviations in the tenth-of-a-millimetre range are inherent to printing and are not defects.
Resin pieces are brittle and not suitable for children under 14.
Liability
Liability for slight negligence is excluded as far as legally permitted; liability for intent, gross negligence, personal injury and under the Product Liability Act remains unaffected.
There is no liability for damage from use contrary to purpose, such as heat, solvents or mechanical force.
Dispute resolution and law
The seller is neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
Austrian law applies; mandatory consumer protection rules of the country of residence remain unaffected.
